Tow Truck Insurance Fairfield Ohio – Have You Read Your Policy Yet?

Chances are good that you have purchased some kind of insurance before, such as car insurance or homeowners insurance. Before you settled on coverage did you read your policy?

If you said no, you are probably not alone. Many people do not bother to give their insurance policies much thought, but such a blasé attitude toward your insurance coverage can be dangerous because of those pesky exclusions of coverage we have mentioned before.

Exclusions of coverage are specific situations pointed out in the language of an insurance policy for which coverage would not be granted by the insurance company. The only way to make yourself aware of the exclusions of coverage lurking in your insurance policy is to read your policy very carefully!

Tow Truck Insurance Fairfield Ohio – Claims Scenario

In our last article we learned how “Penny Pincher” Perry Plumbucket suffered serious financial damage because of an exclusion of coverage that he was not aware of. He assumed that his policy protected his trucks from collision with an animal but it turned out that that wasn’t the case.

We then posed this follow-up question: Since a personal automobile insurance policy would have covered a claim due to collision with an animal such as a deer, why is damage caused by an animal not listed on “Penny Pincher” Perry’s insurance policy?

The answer is simple, and an important lesson to learn and be aware of: though there are often similarities, insurance coverage differs from company to company. What is covered by one insurance company’s policy may not necessarily be covered by another’s policy.

Let’s compare snippets from two different companies’ commercial auto insurance policies to illustrate this fact. The following are examples of a type of coverage usually called “Specified Causes of Loss”:

Company A:

INSURING AGREEMENT – FIRE AND THEFT WITH COMBINED ADDITIONAL COVERAGE (CAC)

Subject to the Limits of Liability, if you pay the premium for Specified Causes of Loss Coverage we will pay for loss to your insured auto and its permanently attached equipment caused by:

  1. fire, lightning or explosion;
  2. theft;
  3. windstorm or hail;
  4. earthquake;
  5. flood or rising water;
  6. malicious mischief or vandalism;
  7. the stranding, sinking, burning, collision, or derailment of any conveyance in or upon which your insured auto is being transported; or
  8. collision with a bird or animal.

No losses other than those specifically described above will be covered under Part II of this policy.

As you can see, Company A’s policy provides coverage for collision with an animal, as well a handful of other forms of damage.

Company B

SECTION III – PHYSICAL DAMAGE

Coverage 1. We will pay for loss to a covered auto or its equipment under Specified Causes of Loss Coverage Caused by:

  1. Fire, lightning or explosion;
  2. Theft;
  3. Windstorm, hail or earthquake;
  4. Flood;
  5. Mischief or vandalism; or
  6. The sinking, burning, collision or derailment of any conveyance transporting the covered auto.

As you can see, Company B’s policy looks very similar to Company A’s, but you’ll notice that coverage for collision with a bird or animal is missing.

The difference is subtle. How do you guard yourself against overlooking something like this? Like we said before: by reading your policy very carefully.

Strongsville Ohio Tow Truck Insurance – Exclusions of Coverage – Don’t Skip Reading the Fine Print!

Today we will continue to look at exclusions of coverage in the typical commercial auto insurance policy. Exclusions of coverage are specific situations where coverage for a certain type of claim could be denied by the insurance company.

Exclusions of coverage are listed in the commercial auto insurance policy and it’s important to understand what is not covered.

Strongsville Ohio Tow Truck Insurance – Coverage Scenario.

The last time we saw “Penny Pincher” Perry Plumbucket, owner of Pretty Perry’s Punctual Towing Emporium, he had just received a call from one of his tow truck drivers.

While driving down a dark country road, a group of deer ran across the road and the driver, before he had time to react, hit the last one head on causing a significant amount of damage to the tow truck to the tune of $22,624 of damages.

Only one week after Perry files a claim for damage to his tow truck he receives notice from his insurance company informing him that his claim has been denied!

How can this be?

To answer that question, we must take a look at Perry’s policy. Remember that Perry went with a type of coverage called Specified Causes of Loss Coverage?

This kind of coverage only protects your vehicles from damage due to specific causes clearly listed in the policy. So in other words, for coverage to apply the claim event must be listed in his policy.

Here is that section from Perry’s policy:

We will pay for loss to a covered auto or its equipment under Specified Causes of Loss Coverage Caused by:

(1) Fire, lightning or explosion; (2) Theft; (3) Windstorm, hail or earthquake; (4) Flood; (5) Mischief or vandalism; or (6) The sinking, burning, collision or derailment of any conveyance transporting the covered auto.

Do you see something missing?

Yes indeed. Collision with an animal is not listed as a covered peril under the coverage he had chosen. Therefore, it is not covered!

That’s a pretty tough lesson to learn the hard way. Perry writes a check for $22,624 to the body shop to get his tow truck back in running order.

Here’s a follow-up question: a personal automobile insurance policy would have covered a claim due to an accident with an animal.

Why is damage caused by an animal not listed on Perry’s insurance policy?

We will answer that question in next week’s article.

As you’re shopping for Tow Truck Insurance in Ohio pay careful attention to the exclusions of coverage on your policy.

Beavercreek Ohio Tow Truck Insurance – Exclusions of Coverage.

In case your recollection is fuzzy, exclusions of coverage are specific situations pointed out in the language of an insurance policy for which coverage would not be approved by the insurance company. We’ve looked at the topic of exclusions of coverage several times before, so this week we’re going to look at them from a slightly different angle.

In addition to being aware of the exclusions of coverage present in your insurance policy, it is also important to be aware that no two insurance providers’ policies are exactly the same; what’s covered by one policy will not necessarily be covered by the other.

Also, as we’ll learn in the upcoming coverage scenario, in some instances the language of your policy will spell out the specific cases in which coverage is provided, meaning that any cause not on that list is excluded.

As with any exclusions of coverage question, the advice we give at Pathway Insurance to our policyholders is to read your policy very carefully!

You want to know what is and, more importantly, is not covered on your Ohio Tow Truck Insurance policy so you won’t be caught off guard by a claim denial in the future.

Beavercreek Ohio Tow Truck Insurance – Coverage Scenario

“Penny Pincher” Perry Plumbucket is the owner of Pretty Perry’s Punctual Towing Emporium. Perry is known as a Penny Pincher for a reason; he saves money and cuts corners where he can. That can often be a good thing, but Perry tends to take it too far, even where safety is concerned.

So it should come as no surprise that when choosing an insurance policy for his fleet of tow trucks, Perry Plumbucket chose the cheapest up-front option.

His insurance provider offers Comprehensive coverage, which essentially covers damage by any cause, but they also offer something called Specified Causes of Loss Coverage.

Specified Causes of Loss Coverage protects your vehicles from damage due to specific causes listed in the policy.

Penny Pincher Perry doesn’t bother to read his policy, let alone the list of specified causes. He pays what he owes and gets back to work.

We’ll see how that goes for Perry in next week’s article.

Cleveland Heights Ohio Tow Truck Insurance – Exclusions of Coverage.

This week we will continue the theme of exclusions of coverage. Just in case you’ve forgotten what exclusions of coverage are, we define them as specific situations pointed out in the language of an insurance policy for which coverage would not be approved by the insurance company.

The advice we give at Pathway Insurance to our policyholders when it comes to exclusions of coverage is to read your policy very carefully!

You want to know what is and, more importantly, is not covered on your Ohio Tow Truck Insurance policy so that you can’t be blindsided by a claim denial down the road. Reading the policy really is the best way to achieve that.

Bearing that in mind, let’s conclude our claims scenario to illustrate the importance of knowing your policy’s exclusions of coverage.

Tow Truck Insurance Cleveland Heights – Coverage Scenario.

When we left off, the lawyer representing Walter’s Repair and Tow contacted Jeff to persuade him to drop the case, or else they will petition the judge for a declaratory judgment.

When Jeff still does not back down, the lawyer suggests that he may be eligible for workers compensation under Walter’s Repair and Tow’s policy.

Jeff continues to hold out for a bigger payout, however, so the lawyer tells Jeff that he’ll email him a copy of Walter’s tow policy and highlight what it says in regards to Jeff’s situation.

The next morning Jeff opens an email in his inbox from the lawyer. Attached is a copy of Walter’s policy with a particular section highlighted:

Employee Indemnification and Employer’s Liability Bodily injury to:

a . An employee of any insured arising out of or within the course of:
(i) That employee’s employment by any insured; or
(ii) Performing duties related to the conduct of any insured’s business; or
b . The spouse, child, parent, brother or sister of that employee as a consequence of Paragraph a. above.

Put more succinctly, coverage is excluded for bodily injury to the spouse of the employee as a consequence of the employee’s employment. And since Jeff’s wife was injured as a direct result of Jeff’s duties while on the job, she would not be covered.

So while Jeff might be eligible for workers compensation under his employer’s policy, his wife certainly is not.

Out of anger, Jeff doubles down. He rants belligerently about how he’ll have his day in court. Just as the lawyer promised, within weeks the judge issues a declaratory judgment that effectively quashes Jeff’s lawsuit and labels it groundless.

Defeated, Jeff drops the lawsuit. He is fired from his towing job and has to start liquidating all the fancy stuff he bought with the settlement money from the first lawsuit to come up with money for his wife’s medical bills.

Cleveland Heights Tow Truck Insurance – Call Us Today!

If Jeff had understood the language of his employer’s policy as it relates to him as an employee then he might have thought twice about filing a lawsuit.

Mentor Ohio Tow Truck Insurance – Exclusions of Coverage.

This week we will continue the theme of exclusions of coverage. To jog your memory in case you forgot what that means, exclusions of coverage are specific situations pointed out in the language of an insurance policy for which coverage would not be approved by the insurance company.

At Pathway Insurance, the advice we give our policyholders when it comes to exclusions of coverage is to read your policy very carefully!

With that in mind let’s continue our claims scenario to illustrate the importance of knowing your policy’s exclusions of coverage.

Tow Truck Insurance Mentor Ohio – Coverage Scenario Continued.

When last we left off, Jeff had filed a lawsuit Pro Se (meaning he will be representing himself instead of hiring a lawyer) against his employer, Walter’s Repair and Tow.

Shortly after filing the suit, however, Jeff received a phone call from the attorneys representing Walter’s insurance company informing Jeff that he simply has no grounds for a case. If he doesn’t drop the lawsuit, they will petition the judge for a Declaratory Judgment.

Jeff rudely tells the lawyer to hold for a minute while he looks something up.

He ambles over to his computer and hurriedly looks up the definition of a declaratory judgment on Wikipedia:

“…a form of legally binding preventive adjudication by which a party involved in a… legal matter can ask a court to conclusively rule on… the rights, duties, or obligations of one or more parties in a civil dispute” -Wikipedia

Jeff is no legal rocket scientist but he thinks he can still bluff his way into a large settlement and he gets back on the line and tells the lawyer this:

“I and my wife got injured and we are due for some compensation!”

The lawyer, quickly detecting Jeff is not the sharpest tool in the box, mentions that he might be eligible for workers compensation under his employer’s policy.

Jeff only gets angrier as he is looking for the BIG payout.

“That ain’t good enough you hear!” Jeff screams into the phone.

The lawyer decides the best course of action is to email Jeff the policy language in the insurance policy.

“Let me do this Jeff. I’ll email you a copy of Walter’s tow policy and highlight what it states and then how about we speak again by phone in a few days?”

Jeff reluctantly agrees.

We will conclude our article next week by examining the legal language of the commercial auto insurance policy.

Tow Truck Insurance Dayton Ohio – Coverage Scenario.

If he doesn’t drop the lawsuit, they say, then they threaten to petition the judge for a Declaratory Judgment.

“…a form of legally binding preventive adjudication by which a party involved in a… legal matter can ask a court to conclusively rule on… the rights, duties, or obligations of one or more parties in a civil dispute” -Wikipedia

From what Jeff can gather, it sounds like a declaratory judgment could mean his lawsuit will be dead before it ever reaches court.

Furthermore, the lawyers point out that though Jeff might be eligible for workers compensation under his employer’s policy, his wife certainly is not. The attorneys point Jeff to the following excerpt from the insurance policy covering Walter’s Repair and Tow:

Employee Indemnification and Employer’s Liability Bodily injury to:

  1. An employee of any insured arising out of or within the course of:
    • That employee’s employment by any insured; or
    • Performing duties related to the conduct of any insured’s business; or
  2. The spouse, child, parent, brother or sister of that employee as a consequence of Paragraph 1. above.

Put more succinctly, coverage is excluded for bodily injury to the spouse of the employee as a consequence of the employee’s employment. And since Jeff’s wife was injured as a direct result of Jeff’s duties while on the job, she would not be covered.

Crestfallen from the knowledge that his case has no grounds, Jeff ultimately drops the lawsuit. He is fired from his towing job and has to start liquidating all the fancy stuff he bought with the settlement money from the first lawsuit to come up with money for his wife’s medical bills.

Tow Truck Insurance Columbus Ohio – Exclusions of Coverage.

In this week’s article we’re continuing the exclusions of coverage theme. To recap, exclusions of coverage are specific situations pointed out in the language of an insurance policy for which coverage would not be granted by the insurance company.

As we’ve said before, the best advice we can give at Pathway Insurance when it comes to exclusions of coverage is to read your policy very carefully!

It is the most reliable way to fully understand what is and is not covered on your Ohio Tow Truck Insurance policy.

The following is a claims scenario to illustrate the importance of knowing your policy’s exclusions of coverage. Let’s see how it concludes:

Columbus Ohio Tow Truck Insurance – Coverage Scenario.

You may recall that Jeff Johannson drives a tow truck for a towing company, and he’s known around town for having won a hefty sum of money from a lawsuit a few years back.

When last we left Jeff, he and his wife had just been injured while Jeff was on the job. He was too busy arguing with his wife, whom he was giving a ride to the casino, to notice that he had improperly attached the hook of his tow truck to a customer’s car. The car came loose and rolled on top of the couple.

With his arm broken and his wife in the emergency room, Jeff sees another opportunity to make easy money.

Jeff thinks he can file a lawsuit against his employer, Walter and obtain a large 6 figure settlement. Jeff realizes he’ll quickly get fired by Walter but believes the big settlement will be worth it, plus he will be able to collect unemployment after getting the axe.

Jeff writes up the lawsuit using big legal terms such as loss of consortium and untold pain and suffering to make his case. Jeff knows that his boss has $5 million of coverage and plenty of money in the bank and expects a quick and large settlement from Walter’s insurance company.

Jeff prepares his lawsuit papers, and files them at the court house after paying his fee.

Is Jeff getting ready to make his second big pay day?

We will learn the answer in next week’s post to see what happens.
