Company A:

INSURING AGREEMENT – FIRE AND THEFT WITH COMBINED ADDITIONAL COVERAGE (CAC)

Subject to the Limits of Liability, if you pay the premium for Specified Causes of Loss Coverage we will pay for loss to your insured auto and its permanently attached equipment caused by:

  1. fire, lightning or explosion;
  2. theft;
  3. windstorm or hail;
  4. earthquake;
  5. flood or rising water;
  6. malicious mischief or vandalism;
  7. the stranding, sinking, burning, collision, or derailment of any conveyance in or upon which your insured auto is being transported; or
  8. collision with a bird or animal.

No losses other than those specifically described above will be covered under Part II of this policy.

As you can see, Company A’s policy provides coverage for collision with an animal, as well a handful of other forms of damage.

Company B

SECTION III – PHYSICAL DAMAGE

Coverage 1. We will pay for loss to a covered auto or its equipment under Specified Causes of Loss Coverage Caused by:

  1. Fire, lightning or explosion;
  2. Theft;
  3. Windstorm, hail or earthquake;
  4. Flood;
  5. Mischief or vandalism; or
  6. The sinking, burning, collision or derailment of any conveyance transporting the covered auto.

As you can see, Company B’s policy looks very similar to Company A’s, but you’ll notice that coverage for collision with a bird or animal is missing.

The difference is subtle. How do you guard yourself against overlooking something like this? Like we said before: by reading your policy very carefully.

This kind of coverage only protects your vehicles from damage due to specific causes clearly listed in the policy. So in other words, for coverage to apply the claim event must be listed in his policy.

Here is that section from Perry’s policy:

We will pay for loss to a covered auto or its equipment under Specified Causes of Loss Coverage Caused by:

(1) Fire, lightning or explosion; (2) Theft; (3) Windstorm, hail or earthquake; (4) Flood; (5) Mischief or vandalism; or (6) The sinking, burning, collision or derailment of any conveyance transporting the covered auto.

Do you see something missing?

Yes indeed. Collision with an animal is not listed as a covered peril under the coverage he had chosen. Therefore, it is not covered!

That’s a pretty tough lesson to learn the hard way. Perry writes a check for $22,624 to the body shop to get his tow truck back in running order.

Here’s a follow-up question: a personal automobile insurance policy would have covered a claim due to an accident with an animal.

The next morning Jeff opens an email in his inbox from the lawyer. Attached is a copy of Walter’s policy with a particular section highlighted:

Employee Indemnification and Employer’s Liability Bodily injury to:

a . An employee of any insured arising out of or within the course of:
(i) That employee’s employment by any insured; or
(ii) Performing duties related to the conduct of any insured’s business; or
b . The spouse, child, parent, brother or sister of that employee as a consequence of Paragraph a. above.

Put more succinctly, coverage is excluded for bodily injury to the spouse of the employee as a consequence of the employee’s employment. And since Jeff’s wife was injured as a direct result of Jeff’s duties while on the job, she would not be covered.

So while Jeff might be eligible for workers compensation under his employer’s policy, his wife certainly is not.

Out of anger, Jeff doubles down. He rants belligerently about how he’ll have his day in court. Just as the lawyer promised, within weeks the judge issues a declaratory judgment that effectively quashes Jeff’s lawsuit and labels it groundless.

Defeated, Jeff drops the lawsuit. He is fired from his towing job and has to start liquidating all the fancy stuff he bought with the settlement money from the first lawsuit to come up with money for his wife’s medical bills.

The lawyer, quickly detecting Jeff is not the sharpest tool in the box, mentions that he might be eligible for workers compensation under his employer’s policy.

Jeff only gets angrier as he is looking for the BIG payout.

“That ain’t good enough you hear!” Jeff screams into the phone.

The lawyer decides the best course of action is to email Jeff the policy language in the insurance policy.
